Input tax credit of about Rs 8.21 lakh for 2017-18 and Rs 3.53 lakh for 2018-19 was denied because of mismatches between the suppliers' GSTR-1 and the recipient's GSTR-2A. The Court declined to interfere in writ jurisdiction, holding that where suppliers do not act on requests to correct their returns the credit availed is liable to be repaid, and that the appropriate remedy is a statutory appeal under Section 107. Thirty days were given to file the appeal.

The Central Goods and Services Tax (Fourth Amendment) Rules, 2020 inserted a proviso to Rule 36(4) so that the ten per cent restriction on credit for invoices not uploaded by suppliers would not be tested month by month for February to August 2020. Instead the condition applied cumulatively, and the cumulative adjustment had to be made in the GSTR-3B for September 2020. The amendment also allowed businesses to opt into the composition scheme for 2020-21 by a later date.

Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. Select the correct cause of payment and period in the form, because a wrongly mapped DRC-03 creates reconciliation trouble later.
How will I be informed of the GST audit findings?
On conclusion of the audit, the officer must inform you of the findings, your rights and obligations, and the reasons for the findings in Form ADT-02 within thirty days. Before that, most audit teams share draft observations and seek your response, which is your best window to knock out weak points with documents. If the audit detects unpaid tax or wrongly availed ITC, you can accept and pay through DRC-03, or contest, in which case the department initiates proceedings under Section 73 or Section 74. Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. Is GST payable on my YouTube AdSense earnings?
AdSense payments come from a Google entity located outside India and are remitted in convertible foreign exchange, so for an Indian creator this revenue generally qualifies as export of services, zero-rated when supplied under an LUT after registration. The income still counts towards your Rs.20 lakh aggregate turnover, so a creator whose combined receipts cross the threshold must register even if the entire revenue is export. Brand sponsorships from Indian companies, by contrast, are domestic supplies taxable at 18 percent. Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
