26th GST Council Meeting, New Delhi — 10 March 2018 (PIB Release ID 1523715) · 2018-03-10
The liability to pay tax on reverse charge basis on supplies received from unregistered persons, already suspended at the 22nd meeting until 31 March 2018, was deferred further to 30 June 2018. A Group of Ministers was appointed to examine the modalities of implementation so that no inconvenience would be caused to trade and industry. The provision was ultimately never revived in its original form and was replaced by a narrower, notified-goods version at the 28th meeting.
Practical effect: Section 9(4) reverse charge on ordinary unregistered purchases never operated after 12 October 2017, which is a complete answer to demands raised on that footing for later periods.
Notification No. 2/2023-Compensation Cess (Rate), dated 31 March 2023 · 2023-03-31
Following the Finance Act, 2023 amendment to the Compensation Cess Act, the cess on pan masala, gutkha, chewing tobacco, zarda and similar products stopped being charged as a percentage of transaction value and became a specific levy computed on the declared retail sale price per unit, with effect from 1 April 2023. Pan masala, for example, moved from an ad valorem rate to a rate expressed as a proportion of retail sale price, a change designed to defeat undervaluation in the tobacco trade.
Why this matters: Tobacco and pan masala dealers must print and track retail sale price per pack, since the cess is now computed on that figure rather than the invoice value.
Maharashtra State Power Generation Co Ltd — AAR Maharashtra, Order No. GST-ARA-15/2017/B-30, dated 8 May 2018 (upheld by AAAR) · 2018-05-08
The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.
What it means for you: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.
