26th GST Council Meeting, New Delhi — 10 March 2018 (PIB Release ID 1523715) · 2018-03-10
The liability to pay tax on reverse charge basis on supplies received from unregistered persons, already suspended at the 22nd meeting until 31 March 2018, was deferred further to 30 June 2018. A Group of Ministers was appointed to examine the modalities of implementation so that no inconvenience would be caused to trade and industry. The provision was ultimately never revived in its original form and was replaced by a narrower, notified-goods version at the 28th meeting.
What to do about it: Section 9(4) reverse charge on ordinary unregistered purchases never operated after 12 October 2017, which is a complete answer to demands raised on that footing for later periods.
Notification No. 17/2024-Central Tax · 2024-09-27
CBIC appointed 27 September 2024 as the commencement date for the first tranche of Finance (No. 2) Act, 2024 GST amendments, including Section 118 of that Act which inserted Sections 16(5) and 16(6) of the CGST Act. Those provisions retrospectively allow input tax credit for FY 2017-18 to 2020-21 if claimed in any GSTR-3B filed up to 30 November 2021, and restore credit where returns were filed after revocation of cancellation. The bulk of the remaining amendments, including the Section 128A interest and penalty waiver scheme, were brought into force from 1 November 2024.
Why this matters: Demands built purely on the old Section 16(4) time limit for 2017-18 to 2020-21 became legally unsustainable from this date, so contest or seek rectification of any such order.
Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24
This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.
What to do about it: The late fee waiver here is conditional: if the GSTR-3B was not filed by the notified date, late fee runs from the original due date, so the actual filing date decides whether any waiver survives.
