CBIC clarified that granting a loan or advance between related persons, including by an overseas affiliate to its Indian affiliate, is a supply of service, but the consideration for that service is represented only by interest or discount, which is exempt. Where no processing fee, service fee or administrative charge is levied, there is no taxable consideration, and no notional interest can be imputed merely because the parties are related. GST applies only to fees actually charged.

Taxpayers with aggregate turnover of Rs 5 crore or more in the preceding financial year filed by the 20th of the following month. Taxpayers below that threshold filed by the 22nd or the 24th depending on the State in which their principal place of business was located, with Tamil Nadu falling in the 22nd group. It ceased to matter from January 2021, when the quarterly scheme and the rewritten Rule 61 took over the return calendar.

Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
