The Council decided that all taxpayers would file GSTR-3B with payment of tax by the 20th of the succeeding month until March 2018, and that for GSTR-1 taxpayers would be divided by turnover. Those with annual aggregate turnover up to Rs 1.5 crore would file GSTR-1 quarterly, and those above that figure monthly, with a detailed table of due dates. Filing of GSTR-1 was to continue without requiring GSTR-2 and GSTR-3 for the previous period.

The Bank of Nova Scotia - AAR Tamil Nadu, Order No. TN/23/AAR/2018, dated 31 December 2018 · 2018-12-31

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Yes. My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
How do I handle GST when expired medicines are returned to the distributor?
CBIC Circular 72/46/2018 gives two routes for time-expired drugs. The return can be treated as a fresh supply by the person returning them, with a tax invoice if that person is registered, or the original supplier can issue a credit note under Section 34; the tax adjustment on a credit note is available only if it is reported within the statutory window, now 30 November following the financial year of supply. Where the manufacturer ultimately destroys the expired stock, input tax credit relating to the destroyed goods must be reversed under Section 17(5)(h). How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
Is there a late fee if I delay the monthly PMT-06 payment under QRMP?
No late fee applies to a delayed PMT-06 deposit, because late fee is linked only to returns. However, interest at 18 percent per annum is payable on the shortfall for the delay period. Note that if you used the fixed sum method and paid the pre-filled 35 percent amount on time, no interest applies for the first two months even if actual liability was higher, provided the balance is paid in the quarterly GSTR-3B by its due date. Late fee does apply if the quarterly GSTR-1 or GSTR-3B itself is filed late.
What is the QRMP scheme and can my business opt for it?
QRMP stands for Quarterly Return filing and Monthly Payment. Taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year can opt in. Under the scheme you file GSTR-1 and GSTR-3B once a quarter instead of every month, but you still pay tax monthly through challan PMT-06 for the first two months of the quarter. After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. Run emSigner as administrator, keep the token connected, and use the trusted-site settings the portal recommends.
