An advertising agency was charged value added tax on the entire consideration although service tax had already been paid on the design element. The Supreme Court held that payments of service tax and of value added tax are mutually exclusive, so in a composite contract the value attributable to the service component cannot also be subjected to sales tax, and the two levies must attach to distinct parts of the transaction. Double taxation of the same value is impermissible.

Circular No. 99/18/2019-GST dated 23 April 2019 · 2019-04-23

Following Removal of Difficulty Order No. 05/2019-Central Tax, CBIC clarified that a person whose registration was cancelled on or before 31 March 2019 for non-filing of returns could apply for revocation up to 22 July 2019. Where cancellation took effect from the order date, all returns up to that date had to be filed first. Where it was cancelled retrospectively, returns for the whole period from the effective date of cancellation had to be furnished within thirty days of the revocation order.

Practical effect: This was the first revocation amnesty and set the pattern of every later one, so a Chennai business with a dormant cancelled GSTIN should watch for such windows.

Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
My landlord in Valasaravakkam has no GSTIN but my business is registered. Who pays GST on the shop rent?
You do. With effect from 10 October 2024, renting of immovable property other than a residential dwelling by an unregistered person to a registered person was brought under reverse charge through Notification 09/2024-Central Tax (Rate). Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
My shop was closed for a month. Can I skip filing GST returns for that period?
No. Once you hold an active GSTIN, returns must be filed for every tax period regardless of business activity. If there were no sales and no purchases, you must file nil GSTR-1 and nil GSTR-3B for that month. Skipping creates a break in the sequential filing chain, blocks future returns, accumulates late fees and can eventually lead to suspension of registration. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act. Before this date the position was contested, with advance rulings going both ways, so credits availed for earlier periods may still be defensible on merits if questioned. For current periods, GST on CSR purchases, whether school furniture donated or medical supplies distributed, is a cost. During suspension you cannot issue tax invoices or file returns, which freezes the business. If cancellation happens, revocation must be sought through REG-21 within 90 days after clearing all dues. What is the GST rate on a works contract for a commercial building?

Do I have to issue an invoice for every small cash sale in my shop?
Not necessarily. Where the value of a supply is less than Rs.200, the buyer is unregistered, and the buyer does not ask for an invoice, you may skip issuing an individual tax invoice. Instead, you must prepare one consolidated tax invoice at the close of each day covering all such small sales. The moment a customer demands an invoice, or the sale is Rs.200 or more, a proper invoice is required. Retail counters typically issue system receipts to every customer anyway, which is cleaner practice, but the daily consolidated invoice is the legal minimum for petty sales.
How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation.
