The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

The taxpayer filed GSTR-3B late and paid interest only on the net cash portion of the tax. The High Court held that on the language of Section 50 as it then stood, interest ran on the gross liability, because input tax credit is credited to the ledger only when the return is filed. The decision caused wide concern in trade, and Parliament later amended Section 50 with retrospective effect from 1 July 2017 to charge interest only on the cash component in most late-return cases.

What to do about it: For late returns, interest is now generally computed on the cash portion only — if an older notice demands interest on gross tax, rely on the retrospective proviso to Section 50.

I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Under Section 18(6) read with Rule 44, on supply of capital goods on which credit was taken, you must pay the higher of two amounts: the ITC originally availed reduced by five percent per quarter or part thereof from the invoice date, or the tax on the transaction value of the sale. For example, machinery held for three full years has its credit reduced by sixty percent, and you compare the remaining forty percent with the actual tax on the sale price. Refractory bricks, moulds, dies, jigs and fixtures sold as scrap need tax only on transaction value. Compute both figures before invoicing the buyer.
How does ITC reversal work for capital goods used for both taxable and exempt supplies?
Rule 43 treats every commonly used capital good as having a useful life of five years, so its total credit is spread over sixty months for reversal purposes. Each month, one-sixtieth of the credit on all common capital goods is attributed to the period, and the exempt proportion, computed on the exempt-to-total turnover ratio, is reversed in GSTR-3B with applicable interest treatment. Capital goods used exclusively for taxable supplies need no reversal, while those used exclusively for exempt supplies get no credit at all. Keep a capital goods register with commissioning dates, because the sixty-month clock and any change in use must be tracked asset-wise.
If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. For most goods, no. With the rate restructuring of 22 September 2025, compensation cess was discontinued on items such as cars, and the demerit burden was merged into the single 40 percent rate.
