23rd GST Council Meeting, Guwahati — 10 November 2017 (PIB Release ID 1509013) · 2017-11-10
The Council decided that all taxpayers would file GSTR-3B with payment of tax by the 20th of the succeeding month until March 2018, and that for GSTR-1 taxpayers would be divided by turnover. Those with annual aggregate turnover up to Rs 1.5 crore would file GSTR-1 quarterly, and those above that figure monthly, with a detailed table of due dates. Filing of GSTR-1 was to continue without requiring GSTR-2 and GSTR-3 for the previous period.
What to do about it: The turnover-based split between monthly and quarterly GSTR-1 that still determines a Chennai business's filing calendar was created here.
Circular No. 200/12/2023-GST, dated 1 August 2023 · 2023-08-01
Giving effect to the 50th GST Council decisions, CBIC clarified that un-fried and uncooked snack pellets manufactured by extrusion are classifiable under tariff item 1905 90 30 and attract five per cent with effect from 27 July 2023, and that fish soluble paste moved from eighteen to five per cent from the same date. Imitation zari thread or yarn made from metallised polyester or plastic film was placed at five per cent, and past periods were regularised on an as-is basis.
Practical effect: Snack and zari manufacturers in and around Chennai got both a lower rate and protection for past periods, so old demands on these items should be contested with this circular.
Notification No. 85/2020-Central Tax · 2020-11-10
A quarterly filer must still deposit tax for each of the first two months of the quarter in Form GST PMT-06 by the 25th of the following month. This notification prescribed the fixed sum method, under which the taxpayer may simply pay thirty-five per cent of the tax paid in cash in the preceding quarter, or the full cash tax of the preceding month if the previous return was monthly. No interest arises on the shortfall if this route is followed and the quarterly return is filed on time.
What to do about it: Using the fixed sum challan protects a Chennai quarterly filer from interest even if the actual liability for that month turns out to be higher.
