55th GST Council Meeting, Jaisalmer — 21 December 2024 · 2024-12-21

The 55th meeting reduced GST on fortified rice kernel (FRK) to 5 per cent regardless of end use, supporting public distribution fortification programmes. Gene therapy was fully exempted from GST, a major relief for patients of ultra-expensive treatments. Autoclaved aerated concrete (ACC) blocks containing more than 50 per cent fly ash content were classified under HS 6815 at 12 per cent. The Council also reduced the rate of compensation cess to 0.1 per cent on supplies to merchant exporters, bringing it on par with the concessional 0.1 per cent GST rate on such supplies.

What to do about it: Construction suppliers dealing in fly-ash-based AAC blocks should bill at 12 per cent and revisit classification disputes on past supplies.

Ladies hostel run from rented premises, with food, held taxable

Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04

The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.

Rule 36(4) rewritten to remove the provisional credit cushion entirely

Notification No. 40/2021-Central Tax · 2021-12-29

The Central Goods and Services Tax (Tenth Amendment) Rules, 2021 substituted Rule 36(4) with effect from 1 January 2022, aligning the rule with the newly enforced clause (aa) of Section 16(2). Credit may now be availed only in respect of invoices or debit notes which the supplier has furnished in its outward supply statement or through the invoice furnishing facility and which have been communicated to the recipient in Form GSTR-2B. The earlier percentage cushion of twenty, ten and then five per cent disappeared completely, so GSTR-2B became the outer limit of admissible credit.

Practical effect: From January 2022 a Chennai business can claim only what its GSTR-2B shows, so supplier follow-up before the return deadline is now the single most important ITC control.

What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. Such invoices must be reported individually in Table 5 of GSTR-1 with the place of supply, instead of being merged into the consolidated B2C summary. The rule helps states track high-value consumer sales flowing across borders. Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. How do I handle GST when expired medicines are returned to the distributor?
CBIC Circular 72/46/2018 gives two routes for time-expired drugs. The return can be treated as a fresh supply by the person returning them, with a tax invoice if that person is registered, or the original supplier can issue a credit note under Section 34; the tax adjustment on a credit note is available only if it is reported within the statutory window, now 30 November following the financial year of supply. My business had zero sales this month. Do I still need to file GST returns?
Yes. Every registered taxpayer must file returns for every tax period, even when there are no sales, no purchases and no tax liability. In that case you file nil GSTR-1 and nil GSTR-3B. Failure to file nil returns attracts a late fee of Rs.20 per day per return, capped at Rs.500 per return, and breaks the sequential filing chain. The credit note flows into your GSTR-2B as a negative entry, and your GSTR-3B claim should net it off in the same period. With the Invoice Management System introduced on the portal from October 2024, you can accept, reject or keep pending supplier documents, and your action on a credit note directly shapes your GSTR-2B. Reconcile purchase returns, rate differences and discount credit notes monthly so reversals never lag behind.
Do I have to issue an invoice for every small cash sale in my shop?
Not necessarily. Where the value of a supply is less than Rs.200, the buyer is unregistered, and the buyer does not ask for an invoice, you may skip issuing an individual tax invoice. Instead, you must prepare one consolidated tax invoice at the close of each day covering all such small sales. The moment a customer demands an invoice, or the sale is Rs.200 or more, a proper invoice is required. Retail counters typically issue system receipts to every customer anyway, which is cleaner practice, but the daily consolidated invoice is the legal minimum for petty sales.
I deposited money under the wrong head in my GST cash ledger. Why can the amount not be used?
The cash ledger is divided into major heads, IGST, CGST, SGST and cess, and minor heads, tax, interest, penalty, fee and others. An amount deposited under one combination, say CGST-penalty, cannot be directly used to pay under another, say IGST-tax, which is why your balance appears unusable despite money lying in the ledger. The remedy is Form PMT-09, which transfers the amount to the correct head instantly without any officer approval. Is GST charged before or after the discount shown on my invoice?

What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
