Section 9(4) of the CGST Act as originally enacted made a registered person liable to pay tax under reverse charge on all inward supplies received from unregistered persons. This notification granted a de minimis exemption where the aggregate value of such supplies received from all unregistered suppliers did not exceed Rs 5,000 in a day. The exemption proved unworkable in practice and section 9(4) was soon suspended altogether.

The Madras High Court held that such portal-only communication, without any other effective mode such as registered post, does not achieve the objective of putting the taxpayer on notice, set aside the orders, and directed fresh proceedings after proper communication and opportunity of hearing.

This decision is the origin of the Invoice Registration Portal, the IRN and the QR code now mandatory for most mid-sized and large businesses.
