On writ, the Madras High Court reversed that view on 22 March 2024, holding that hostel rooms occupied by girl students and working women as their residence qualify for the exemption for renting of residential dwelling under Entry 12 of Notification No. 12/2017-Central Tax (Rate), and observing that the legislature never intended to burden such occupants with tax.
Why this matters: Hostel and PG operators in Tamil Nadu can rely on the Madras High Court ruling for exemption, but should document residential use of every room.

A five-judge Bench held that circulars issued by the Board cannot prevail over the statute, and are not binding on courts. Where the Supreme Court or a High Court has declared the law on an issue, that declaration prevails and any contrary circular ceases to have effect. Circulars remain an aid to administration and can bind officers, but they cannot enlarge or restrict what the legislature has enacted.
