Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Acting under Section 168A, CBIC extended the time limit for issuing orders under Section 73 in respect of the financial year 2017-18 to 30 September 2023. It also directed that the period from 1 March 2020 to 28 February 2022 be excluded when computing the limitation for issuing a demand order for an erroneous refund, and when computing the two-year period for filing a refund application under Section 54 or Section 55. The exclusion applies automatically and does not require any application.

If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
What happens if I do not reply to an ASMT-10 scrutiny notice?
If no satisfactory explanation is filed within thirty days, or you fail to correct the discrepancies, the officer can escalate the matter to a departmental audit under Section 65, a special audit under Section 66, an inspection under Section 67, or straightaway initiate a demand under Section 73 or Section 74. In practice, unanswered ASMT-10 notices convert into DRC-01A intimations and then show cause notices, where penalties and hearings enter the picture.
