CBIC clarified several refund issues: the value of export goods, for both 'turnover of zero-rated supply of goods' and 'adjusted total turnover' under Rule 89(4), is the lower of the FOB value declared in the shipping bill and the value declared in the tax invoice; the scope of the undertaking required in Form RFD-01 in relation to Section 16(2)(c) was explained; refund of accumulated credit is admissible even where the credit pertains to invoices of an earlier period but was availed in the refund period; and the manner of computing refunds where GSTR-2B based restrictions apply was set out.
What to do about it: Exporters should compute refund claims using the lower of FOB and invoice value and cite this circular when officers seek unwarranted undertakings or reject earlier-period credit.
Tamil Nadu Labour Welfare Board - AAR Tamil Nadu, advance ruling reported August 2021 · 2021
The Board, based at the DMS Campus in Teynampet, Chennai, owned immovable property and let portions of it to government departments and business entities. It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.
What to do about it: Chennai landlords letting premises to government offices must charge GST unless a specific exemption entry clearly covers the letting.

Refund claims for unutilised credit on zero-rated exports of July to September 2017 were filed on 21 September, 9 October and 10 October 2018, returned through deficiency memos, and resubmitted later. The appellate authority treated the resubmissions as fresh applications and rejected them as time-barred. The Court allowed three of the five petitions and quashed those orders, holding that the original applications were within two years of the exports and that a resubmission after curing deficiencies cannot start a new limitation period, the 2021 proviso to Rule 90(3) not applying retrospectively.
Why this matters: Chennai exporters whose refund was returned by a deficiency memo should preserve the original ARN and acknowledgement — limitation is counted from that first filing, not the re-filed one.
