Entry 18 exempts transportation of goods by road and by inland waterways, but carves out two categories: a goods transport agency and a courier agency. The practical effect is that a truck owner who simply carries goods without issuing a consignment note supplies an exempt service, while a transporter who issues a consignment note becomes a goods transport agency and his service is taxable, usually in the hands of the recipient under reverse charge. The consignment note is therefore the dividing line between exemption and taxability.
What to do about it: Before paying reverse charge on a Chennai freight bill, check whether the transporter actually issued a consignment note, because a plain lorry hire without one is exempt.

The Supreme Court held that where a special taxing statute provides a complete code with its own limitation scheme, the general provisions of the Limitation Act permitting condonation of delay do not apply. Delay in filing a reference or appeal beyond the period prescribed by the special statute cannot be condoned. The scheme, language and object of the special Act determine whether the Limitation Act is impliedly excluded.

The Council approved what became the Quarterly Return Monthly Payment scheme. Registered persons with aggregate annual turnover up to Rs 5 crore were allowed to furnish GSTR-3B on a quarterly basis from 1 January 2021, while paying tax monthly through a challan. The due date for the quarterly GSTR-1 was fixed at the 13th of the month following the quarter, and an invoice furnishing facility was provided so that recipients could still see credit monthly. This remains the default compliance route for most small businesses.
What to do about it: A Chennai business under Rs 5 crore can file GSTR-3B four times a year instead of twelve, but must still deposit tax every month, and missing that monthly challan attracts interest.
