The liability to pay tax on reverse charge basis on supplies received from unregistered persons, already suspended at the 22nd meeting until 31 March 2018, was deferred further to 30 June 2018. A Group of Ministers was appointed to examine the modalities of implementation so that no inconvenience would be caused to trade and industry. The provision was ultimately never revived in its original form and was replaced by a narrower, notified-goods version at the 28th meeting.

What to do about it: Section 9(4) reverse charge on ordinary unregistered purchases never operated after 12 October 2017, which is a complete answer to demands raised on that footing for later periods.

Coronation Arts Crafts - AAR Tamil Nadu, Advance Ruling No. 19/ARA/2022, dated 31 May 2022 · 2022-05-31

A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

Circular No. 31/05/2018-GST dated 9 February 2018 · 2018-02-09

CBIC assigned the proper officers for issuing show cause notices and orders under sections 73 and 74 of the CGST Act and section 20 of the IGST Act, with monetary limits based on the central tax and integrated tax involved. Superintendents were empowered for smaller demands, Deputy or Assistant Commissioners for the middle range, and Additional or Joint Commissioners above that. The circular was later amended by Circular No. 169/01/2022-GST.

Practical effect: When a DRC-01 arrives, check whether the officer who signed it had jurisdiction over that amount, because a notice issued beyond the monetary limit is open to challenge.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I applied for GST registration in Virugambakkam and received a REG-03 notice. What does it mean?

What is the difference between GST return scrutiny and a departmental audit?
Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. Scrutiny can be closed with a good reconciliation; an audit needs sustained document management and negotiation over weeks. Both, if unresolved, end in Section 73 or 74 demands, so early professional handling pays.
I received Form ADT-01 saying my business is selected for GST audit. What does it mean?
ADT-01 is the intimation that the department will conduct an audit of your records under Section 65. The notice must be issued at least fifteen working days before the audit begins and will specify the financial years covered and the documents required. The audit may happen at your place of business or at the department's office. It is a detailed examination of returns, books, ITC claims and classifications, not a routine visit.
