Mr. Kannippan Arumugan v. Assistant Commissioner (ST) — Madras High Court, W.P. No. 2943 of 2026, decided 30 January 2026 (C. Saravanan J.) · 2026-01-30
The taxpayer had reported tax of Rs 2,54,040.30 against an invoice instead of the correct Rs 1,31,280.30, and a demand followed. The Court quashed the assessment order dated 21 July 2025 and remitted the matter for fresh adjudication within six months, permitting the petitioner to rectify the inadvertent error subject to compliance with Circular No. 212/6/2024-GST, and directing the officer to verify with the recipient's jurisdiction whether excess credit had in fact been availed.
How we apply it: A clerical overstatement in GSTR-1 by a Chennai supplier can still be corrected long afterwards, provided the recipient has not taken the excess credit and the Circular 212 procedure is followed.
42nd GST Council Meeting (video conferencing) — 5 October 2020 · 2020-10-05
The Council approved what became the Quarterly Return Monthly Payment scheme. Registered persons with aggregate annual turnover up to Rs 5 crore were allowed to furnish GSTR-3B on a quarterly basis from 1 January 2021, while paying tax monthly through a challan. The due date for the quarterly GSTR-1 was fixed at the 13th of the month following the quarter, and an invoice furnishing facility was provided so that recipients could still see credit monthly. This remains the default compliance route for most small businesses.
How we apply it: A Chennai business under Rs 5 crore can file GSTR-3B four times a year instead of twelve, but must still deposit tax every month, and missing that monthly challan attracts interest.
Circular No. 203/15/2023-GST · 2023-10-27
CBIC clarified three recurring place-of-supply questions. For transportation of goods, including by mail or courier, where the supplier or the recipient is outside India, Section 13(9) of the IGST Act stood omitted from 1 October 2023, so the place of supply is now fixed by the default rule in Section 13(2), namely the location of the recipient. For advertising services supplied to a government body, the place of supply follows the location of the recipient under Section 12(2) rather than the location of the hoardings, with State-wise allocation where the contract provides for it. For co-location of servers in a data centre, the supply is a bundle of hosting services and not a letting of immovable property, so the recipient's location governs.
Practical effect: Chennai courier, advertising and data centre businesses should map their invoices to these tests before deciding between IGST and CGST plus SGST.
