This single number determined the size of the compensation bill for the five-year guarantee period and, when actual GST collections fell short of it, drove the compensation cess extensions and the back-to-back borrowing arrangements of later years.

The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

CBIC notified the GSTR-3B due dates for the six months from October 2020 to March 2021. Taxpayers with aggregate turnover of Rs 5 crore or more in the preceding financial year filed by the 20th of the following month. Taxpayers below that threshold filed by the 22nd or the 24th depending on the State in which their principal place of business was located, with Tamil Nadu falling in the 22nd group. It ceased to matter from January 2021, when the quarterly scheme and the rewritten Rule 61 took over the return calendar.

The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
I am a composition dealer. Which returns apply to me and when?
Composition taxpayers do not file GSTR-1 or GSTR-3B. Instead, you pay tax every quarter through statement CMP-08, due by the 18th of the month following the quarter, and file one annual return, GSTR-4, by 30 June following the financial year. The scheme is available for turnover up to Rs.1.5 crore for goods, with a separate 6 percent scheme for service providers up to Rs.50 lakh. Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. Retail schemes such as festival discounts and trade margins should always be structured to print on the invoice.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Vyasarpadi buying stationery from an unregistered shop has no Section 9(4) liability at all.
Is GST still charged on health insurance premiums?
Not on individual policies. The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. Is GST still charged on life and health insurance premiums?
No. With effect from 22 September 2025, premiums on all individual life insurance policies, including term plans, endowment plans and ULIPs, and all individual health insurance policies, including family floater and senior citizen plans, are exempt from GST.
