The Authority did not admit the application under section 98(2) of the CGST and TNGST Acts, holding that an advance ruling can be sought only by a person who is undertaking or proposing to undertake the supply in question. A recipient cannot use the advance ruling route to settle the classification or the rate charged to it by its vendor.

Following High Court rulings on the constitutional requirement to inform an arrested person of the grounds of arrest, CBIC revised its arrest guidelines. The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.
Why this matters: If a summons escalates towards arrest, insist on written grounds of arrest, as their absence has repeatedly led courts to set aside GST arrests.

CBIC clarified that granting a loan or advance between related persons, including by an overseas affiliate to its Indian affiliate, is a supply of service, but the consideration for that service is represented only by interest or discount, which is exempt. Where no processing fee, service fee or administrative charge is levied, there is no taxable consideration, and no notional interest can be imputed merely because the parties are related. GST applies only to fees actually charged.
