Notification No. 05/2022-Central Tax (Rate) dated 13.07.2022 · 2022-07-13
This notification inserted a new entry in the services reverse charge list so that, from 18 July 2022, where a residential dwelling is rented to a registered person, that registered person must pay the tax. The landlord does not charge GST and often is not even registered. The registered tenant issues a self-invoice, pays 18 per cent in cash and takes credit where the premises are used for business. The measure targeted rent paid by companies for guest houses and employee accommodation.
Why this matters: Any Chennai registered business paying rent for a residential flat must self-invoice and pay GST on that rent every month.
Circular No. 235/29/2024-GST, dated 11 October 2024 · 2024-10-11
Implementing the 54th GST Council decisions, CBIC clarified that extruded or expanded savoury or salted products other than un-fried snack pellets fall under tariff item 1905 90 30 and attract twelve per cent prospectively, while un-fried or uncooked snack pellets continue at five per cent. Roof-mounted package unit air conditioning machines for railway coaches were held classifiable under heading 8415 and not as railway parts, and the rate position on motor car seats was settled.
How we apply it: Namkeen and extruded snack manufacturers must apply the clarified rate prospectively and can rely on the circular's regularisation for earlier supplies.
GSTN Advisory, September 2022 — changes in Table 4 of Form GSTR-3B pursuant to Notification No. 14/2022-Central Tax, dated 5 July 2022 and Circular No. 170/02/2022-GST, dated 6 July 2022 · 2022-09
From the August 2022 return period the whole of the credit appearing in GSTR-2B must first be reported as credit available in Table 4(A), with ineligible and reversible credit then shown separately in Table 4(B). Reversals that can be reclaimed later, such as those under Rule 37, go into Table 4(B)(2) and the reclaim is reported in Table 4(D)(1). Only the net figure reaches the electronic credit ledger.
Practical effect: Report gross credit and reversals separately in Table 4, because the department now compares your ledger with GSTR-2B line by line.
