Old GST returns are being archived and removed from the portal

GSTN Advisory dated 24 September 2024 — archival of GST returns data older than seven years · 2024-09-24

GSTN advised that return data on the common portal is retained for seven years only, after which it is archived and no longer available for viewing or download. Archival started with the earliest tax periods of 2017-18 and proceeds month by month, so one further month of data drops off the portal every month. Taxpayers were advised to download and preserve their returns and supporting data before the archival date for each period.

Council adopts a fixed 14 per cent growth rate for compensation

3rd GST Council Meeting, New Delhi — 18-19 October 2016 (Signed Minutes, Agenda Item 2) · 2016-10-18

The Chairperson offered a compromise between a fixed 13 per cent growth rate, an average of three of the preceding five years' growth after removing the highest and lowest, and a 14 per cent rate pressed by Kerala and Assam. The Council unanimously agreed that projected State revenue for compensation purposes would grow at a flat 14 per cent per year from the 2015-16 base, with CST in that base counted at the actual 2 per cent. This single number determined the size of the compensation bill for the five-year guarantee period and, when actual GST collections fell short of it, drove the compensation cess extensions and the back-to-back borrowing arrangements of later years.

What it means for you: The 14 per cent guarantee is the reason compensation cess outlived its original five-year sunset, so cess-bearing goods remain costlier than the headline GST rate suggests.

Late fee waived on GSTR-1 for the March to May 2020 periods

Notification No. 33/2020-Central Tax · 2020-04-03

CBIC waived the late fee for furnishing the outward supply statement in Form GSTR-1 for the months of March, April and May 2020 and for the quarter ending 31 March 2020, provided the statement was filed on or before 30 June 2020. The relief covered both monthly and quarterly filers. Because GSTR-1 late fee is separate from GSTR-3B late fee, this notification had to be issued in addition to the GSTR-3B waiver of the same date.

What to do about it: A Chennai supplier who filed the March to May 2020 GSTR-1 by 30 June 2020 owes nothing by way of late fee, whatever the portal ledger may currently show.

What is the difference between GSTR-1 and GSTR-3B?
GSTR-1 is a detailed invoice-wise statement of your sales, filed by the 11th of the next month. It does not involve any tax payment but it feeds your customers' GSTR-2B for input tax credit. GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. Both must match; mismatches between GSTR-1 and GSTR-3B are a common trigger for notices from the department, which is why we reconcile them before every filing.
The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We verify these auto-computations for clients before every filing.
How should I raise invoices on foreign clients and report them in my returns?
You may invoice in foreign currency, but your GST records must state the value in rupees. An export invoice under LUT should carry the endorsement that the supply is meant for export under Letter of Undertaking without payment of integrated tax, along with your GSTIN, SAC code and the recipient's overseas address. In GSTR-1, these invoices go into Table 6A marked without payment of tax, and the turnover flows into GSTR-3B as zero-rated supplies. Match every invoice to a FIRC or bank credit. What is a debit note under GST and when do I issue one?

Generally no. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. My shop's landlord in Adyar is not GST registered. Do I pay GST on the rent myself?

My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital.
