A person who merely issues such an invoice has no output tax liability under Sections 73 or 74, because there is no supply at all, but is liable to penalty under Section 122(1)(ii). A person who takes and utilises credit on such an invoice faces demand and penalty under Section 74, and a person who further passes on that credit is treated the same way.
