Coronation Arts Crafts - AAR Tamil Nadu, Advance Ruling No. 19/ARA/2022, dated 31 May 2022 · 2022-05-31

A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

Why this matters: A Chennai printer supplying its own paper should charge 18 percent on job printed leaflets instead of assuming a lower book rate.

Mid-day meal and anganwadi catering treated as exempt

Circular No. 149/05/2021-GST dated 17.06.2021 · 2021-06-17

CBIC clarified that serving food in schools under the mid-day meal programme is exempt from GST, and that the exemption extends to pre-schools and anganwadis, which are covered within the meaning of an educational institution providing pre-school education. It further clarified that the exemption applies whether the meals are funded by government grants or by corporate donations, since the entry does not distinguish by source of funding. The clarification protected non-profit caterers running school feeding programmes from demands.

At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
Can my GST consultant attend a summons hearing on my behalf in Ambattur?

What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
What documents do GST audit officers usually ask for?
Expect to produce the GSTR-1, GSTR-3B and GSTR-9 filings for the audit years, audited financial statements, trial balance, sales and purchase registers, ITC ledgers with supplier-wise detail, fixed asset register, e-way bill data, bank statements, key customer and vendor agreements, stock records and reconciliations between books and returns. The audit may happen at your place of business or at the department's office. It is a detailed examination of returns, books, ITC claims and classifications, not a routine visit. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. Food ordered through e-commerce operators such as Swiggy and Zomato is taxed at 5 percent, with the platform liable to pay the tax on restaurant services supplied through it. Is GST still charged on life and health insurance premiums?

Yes. Import of services, meaning services from a supplier located outside India received by a person in India for business, attracts IGST under reverse charge in the recipient's hands, payable in cash and claimable as ITC if eligible. This catches cloud software, foreign professional fees, overseas advertising and licence fees. Two nuances matter: services from a related foreign party, such as your parent company, are taxable even without consideration under Schedule I, and OIDAR services supplied to unregistered consumers are taxed in the foreign supplier's own hands, not under RCM.
