The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

Practical effect: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

The Supreme Court held that the same transaction may have a goods aspect and a service aspect, and different legislatures may tax different aspects, but the same element cannot be taxed twice. A composite contract cannot be split into goods and services except in the cases specifically permitted by Article 366(29A), such as works contracts and catering. If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. Recipients registered under the composition scheme are excluded from this reverse charge entry. Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again.
