Where an appellate authority, tribunal or court holds that a notice issued under Section 74 is not sustainable because fraud, wilful misstatement or suppression of facts is not established, Section 75(2) requires the proper officer to re-determine the tax as though the notice had been issued under Section 73. The Board clarified that this re-determination must be completed within two years from the date of communication of that order, and only the normal period demand can survive.
What to do about it: Winning on the suppression point in appeal does not end the matter, but it limits the surviving Chennai demand to the normal period and starts a two-year clock on the department.
Notification No. 21/2021-Central Tax (Rate), dated 31 December 2021 · 2021-12-31
On 31 December 2021, the same day as the 46th GST Council meeting convened at the instance of Tamil Nadu and other States, the Government superseded the November notification. The proposed increase on textiles was dropped, so fabrics, yarn, garments and made-ups continued at five per cent, but the footwear change survived and all footwear became taxable at twelve per cent from 1 January 2022 irrespective of price. The value threshold that had earlier kept cheap footwear at five per cent disappeared.
What to do about it: From January 2022 to September 2025 every pair of footwear attracted twelve per cent regardless of price, and rate mistakes in that window are a common scrutiny point.
47th GST Council Meeting, Chandigarh — 28 and 29 June 2022 · 2022-06-29
The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.
Why this matters: Chennai lodges charging under one thousand rupees a night and hospitals with deluxe rooms above five thousand rupees a day both acquired new GST liabilities from 18 July 2022.
