GSTN Advisory dated 31 August 2023 — Electronic Credit Reversal and Re-claimed Statement · 2023-08-31

GSTN introduced the Electronic Credit Reversal and Re-claimed Statement on the portal to track credit reversed in Table 4B(2) of GSTR-3B and later reclaimed in Tables 4D(1) and 4A(5). It applied from the August 2023 return for monthly filers and from the July to September 2023 quarter for quarterly filers. The cumulative opening balance of reversals awaiting reclaim had to be reported by 30 November 2023, with up to three amendments allowed until 31 December 2023. The portal now warns when reclaimed credit exceeds the available balance.

What to do about it: Maintain a running register of credit reversed and reclaimed, because the portal flags excess reclaims and the data feeds departmental scrutiny.

This is the parent notification that fixes the CGST rate for services. It runs as a long table arranged by service accounting code, from construction and works contract under heading 9954, through accommodation, restaurant and transport services, to the residual entry that taxes any service not specifically listed. Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. The credit note references the original invoice, and reporting it in your GSTR-1 reduces your output tax liability for that period. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
My SaaS startup in Ashok Nagar bills both US and Indian customers. Is everything zero-rated?
No. Only the supplies satisfying the export conditions are zero-rated under your LUT. How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. Is GST payable on hostel or paying guest accommodation in Ashok Nagar?

Under Notification 78/2020 Central Tax, taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year must mention a 4-digit HSN code on all B2B tax invoices, though it is optional on B2C invoices. Taxpayers with turnover above Rs.5 crore must mention 6-digit HSN codes on every invoice, including B2C. Eight digits are required for specified goods such as certain chemicals and for export documentation. Services follow the same rule using SAC codes, which begin with 99. Printing truncated or wrong codes on invoices creates mismatches later, so set the codes correctly in your billing software once.
I buy electronics stock from distributors in other states. How does the IGST on purchases work for me?
Inter-state purchases carry IGST, which flows into your GSTR-2B once the distributor files GSTR-1, and it is fully available as input tax credit. When you sell locally in Tamil Nadu you charge CGST and SGST, and the law lets you use IGST credit against both, with the portal applying the set-off order automatically.
