The Supreme Court interpreted Section 6(2)(b) of the CGST Act. It held that a summons under Section 70 is only an inquiry or evidence-gathering step and does not amount to "initiation of proceedings"; proceedings begin when a show cause notice is issued. "Subject matter" means the same cause of action in the same dispute. Once one authority issues a notice on a subject matter, the other authority cannot start parallel proceedings on that identical subject matter.

The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.

Practical effect: Chennai builders who did not formally exercise the option in 2019 are on the one and five per cent no-credit rates, and any credit claimed since then is exposed to reversal.

Refund rules amended for deficiency memos and withdrawal of claims

Notification No. 15/2021-Central Tax · 2021-05-18

The Central Goods and Services Tax (Fourth Amendment) Rules, 2021 made several refund changes. Rule 90 was amended so that the period from the filing of a refund application in Form GST RFD-01 to the communication of the deficiency memo in Form GST RFD-03 is excluded when computing the two-year limitation for the fresh application filed after rectifying the deficiencies. A new facility to withdraw a refund application in Form GST RFD-01W before an order is passed was introduced, with the debited amount credited back to the ledger.

Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. Verify the computation, pay only what is truly due, and contest the balance in Part B with reasons. ChennaiGST routinely trims DRC-01A figures for clients before payment.
I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. Without this mapping, recovery notices can continue despite full payment, so businesses in Avadi with paid-but-open demands should file DRC-03A promptly.
I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction.
