Ultra-high temperature milk became exempt, chena and paneer became exempt whether or not pre-packaged and labelled, and all Indian breads including roti, chapathi, paratha, parotta, khakhra and pizza bread were exempted by name. Pencils, crayons, sharpeners, slates, maps, globes and exercise books were also brought to nil.

Practical effect: Dairy shops and bakeries in Chennai now bill paneer and parotta at nil, but must remember that exempt turnover blocks the corresponding input tax credit.

ALD Automotive (P) Ltd v. Commercial Tax Officer — Supreme Court, (2019) 13 SCC 225, judgment dated 12-10-2018 · 2018-10-12

Dealing with Section 19(11) of the Tamil Nadu VAT Act, the Supreme Court held that input tax credit is a concession created by statute and not an absolute or constitutional right. The legislature may impose conditions, including a time limit for claiming it, and such a limit is mandatory rather than directory. A dealer who claims credit after the prescribed period loses it. This reasoning is routinely applied to Section 16(4) of the CGST Act.

An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. This is how masterminds behind billing rackets are penalised alongside the front companies. Can I use my input tax credit balance to pay a DRC-03 liability?

Can a compliance review actually prevent GST notices?
Largely, yes. Most notices arise from mismatches the portal detects automatically: GSTR-1 versus GSTR-3B tax differences, ITC claimed beyond GSTR-2B, e-way bill turnover gaps and unfiled returns. A periodic review catches these before the system does, so you can correct them through amendments in subsequent returns or a voluntary DRC-03 payment with interest, which under Section 73 attracts no penalty and no notice for the amount paid. What is the GST rate for restaurants and food delivery now?

The transfer reflects in the ledger immediately and an ARN is generated for your records. There is no limit on how often PMT-09 can be filed, and no government fee applies, so it is always the first fix for a wrong-head deposit.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Avadi godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
Which daily-use grocery items became cheaper under GST from September 2025?

Can I reduce GST for discounts given after the sale, like turnover incentives?
Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it. If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect.
