CBIC listed six situations that must not attract detention proceedings where both an invoice and an e-way bill accompany the goods: a spelling mistake in the consignor or consignee name where the GSTIN is correct, a wrong PIN code where the address is correct, an error in one or two digits of the document number, an error in the fourth or sixth digit of the HSN where the rate is right, and an error in the vehicle number. Penalty is only Rs 500 each under CGST and SGST in FORM GST DRC-07.

Practical effect: A typing slip in an e-way bill should cost Rs 1,000, not a section 129 demand of tax and penalty, and this circular is the first thing to quote in reply.

The Andhra Pradesh High Court upheld the constitutional validity of Section 16(4) CGST Act, which bars availment of input tax credit after the prescribed deadline, holding that ITC is a conditional concession and the time limit is neither violative of Articles 14, 19 or 300A nor overridden by the non-obstante acceptance of a belated return with late fee. Parliament subsequently granted relief through Section 16(5), retrospectively extending the deadline for FY 2017-18 to 2020-21 up to 30 November 2021.

Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for Ayanavaram businesses, since no appeal is provided against DRC-22.
