CBIC clarified that under Rule 88B(3), interest under Section 50(3) arises only where wrongly availed input tax credit has actually been utilised. Credit is treated as utilised only if the total balance in the electronic credit ledger falls below the amount of the wrongly availed credit. The total of the IGST, CGST and SGST balances is to be seen together, not head-wise, so a taxpayer who maintained a sufficient overall balance until reversal pays no interest.
What it means for you: When reversing a disputed credit, extract the daily credit ledger balances, since a consistently adequate balance defeats the interest demand entirely.

Five bank accounts were provisionally attached under Section 83 by an order that simply recited that attachment was necessary 'in order to protect the interest of the Revenue'. The Court set the attachment aside, holding that the power under Section 83 is draconian and can be exercised only on a formation of opinion based on tangible material, recorded in a reasoned order. A single-line justification does not meet that standard. Liberty was given to the department to re-attach on proper material.
What to do about it: If a Chennai firm's bank account is frozen under Section 83, obtain a copy of the attachment order at once — an order with no recorded reasons or tangible material is liable to be quashed.

Following widespread demands computing interest on the gross tax liability of a late GSTR-3B, ignoring the credit balance available, the Council recommended that interest under Section 50 be charged only on the net cash tax liability, with retrospective effect from 1 July 2017. This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.
What it means for you: If you have received an interest demand computed on gross output tax for a late return, the net cash liability principle from this meeting is usually a complete answer.
