The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.
Practical effect: Do not automatically charge GST on liquidated damages or penalty recoveries; test each clause against the 2022 circular before paying tax.

CBIC again invoked Section 168A to extend the time for passing orders under Section 73(10) to 30 April 2024 for FY 2018-19 and 31 August 2024 for FY 2019-20. CBIC clarified that the holding of shares by a holding company in its subsidiary is a transaction in securities, and securities are excluded from the definition of both goods and services. Holding shares therefore cannot be treated as a supply of service by the holding company to the subsidiary, and no GST can be demanded on a notional value for such shareholding. Demands raised on this reasoning in audits were directed to be dropped.
