The Supreme Court held that where a developer enters into an agreement with a buyer before construction is completed, the construction carried out thereafter is executed for the buyer and constitutes a works contract liable to tax. Tax can be levied only on the value of goods incorporated after the agreement date, and the value of land must be excluded. The Council created two threshold limits for exemption from registration and payment of GST for suppliers of goods, Rs 40 lakh and Rs 20 lakh, and gave states a week to choose which limit would apply in their territory. The threshold for service providers was left unchanged at Rs 20 lakh, and at Rs 10 lakh for special category states. The change was made operational from 1 April 2019 and remains the basic registration test for traders and manufacturers today.
