The Council completed the fitment exercise for goods and broadly approved GST rates at nil, five, twelve, eighteen and twenty-eight per cent across the tariff, along with the rates of GST compensation cess to be levied on specified goods. A large batch of petitions challenged show cause notices issued under Section 74 for periods from 2021 onwards. The Madras High Court examined whether the jurisdictional facts of fraud, wilful misstatement or suppression of facts to evade tax must be set out in the notice itself, and held that the expression where it appears requires subjective satisfaction supported by material. A notice that does not specify those foundational facts suffers from a jurisdictional defect.
What to do about it: Where a Section 74 notice merely recites the statutory words without alleging specific suppression, challenge the invocation of the extended period at the outset.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.
Why this matters: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.
