Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

What to do about it: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

GST on fertilisers cut to five per cent on the eve of rollout

18th GST Council Meeting, New Delhi — 30 June 2017 (Signed Minutes, Agenda Item 3) · 2017-06-30

Meeting on the day GST was launched, the Council revisited the rate on fertilisers. Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. After almost every State supported relief for farmers, the Chairperson recorded a consensus and the Council agreed to tax fertilisers at five per cent instead of twelve, notwithstanding the inverted duty refund burden this would create for manufacturers whose inputs were taxed at eighteen per cent.

Why this matters: The Council reopened a rate it had already fixed only weeks earlier, and the cut created the inverted duty structure that fertiliser dealers still claim refunds under.

30-day e-invoice reporting window extended to Rs 10 crore taxpayers

GSTN Advisory, November 2024 — 30-day IRP reporting limit for AATO Rs 10 crore and above · 2024-11

GSTN advised that from 1 April 2025, taxpayers with annual aggregate turnover of Rs 10 crore and above cannot report e-invoices on the Invoice Registration Portals beyond 30 days from the document date. The restriction, earlier applicable only to very large taxpayers of Rs 100 crore and above, covers invoices, credit notes and debit notes. The IRP validation simply rejects documents older than 30 days, so late reporting becomes impossible.

What to do about it: Automate same-day or same-week IRN generation, because an invoice missed beyond 30 days cannot be e-invoiced at all and endangers the buyer's ITC.

Do I have to pay GST on my Adobe, Canva or AWS subscriptions billed from abroad?
If you are GST-registered and the foreign supplier has not charged Indian GST, yes. Services received from a supplier located outside India for business purposes are an import of services, taxable in your hands under reverse charge at 18 percent. You must pay the tax in cash through GSTR-3B, raise a self-invoice, and can simultaneously claim the same amount as input tax credit if the expense is otherwise eligible, making it cash-flow neutral for most businesses. Unregistered persons do not pay reverse charge; instead, the foreign provider may charge GST under the OIDAR rules. Many Chepauk agencies miss these entries during scrutiny.
Can I issue a single credit note against several invoices?
Yes. Following the amendment to Section 50, interest on delayed GSTR-3B filing applies only on the portion of tax paid through the electronic cash ledger, not on the amount settled using input tax credit. How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. No, not until it appears. Since 1 January 2022, Section 16(2)(aa) permits ITC only on invoices furnished by the supplier in GSTR-1 and communicated to you in GSTR-2B; the earlier provisional credit tolerance is gone. Claiming credit on a missing invoice invites a Rule 88D intimation and reversal with interest at 18 percent. The practical remedy is vendor follow-up: withhold the tax portion of payment until the supplier uploads, and claim the credit in the month it appears in GSTR-2B, subject to the overall time limit of 30 November following the financial year. Vendor discipline clauses in purchase orders help enormously.
Can nil GSTR-1 also be filed through SMS?
Yes. Send NIL space R1 space your GSTIN space tax period in MMYYYY format (use the quarter-ending month for quarterly filers) to 14409 from the registered mobile number of the authorised signatory. Confirm with the CNF code received, and the portal issues an ARN. A nil GSTR-1 is possible only when there are no outward supplies at all, including no credit notes, amendments or documents to report for that period. What is the late fee for filing GSTR-9 after the due date?
From FY 2022-23 onwards, the late fee is turnover-linked. For turnover up to Rs.5 crore it is Rs.50 per day (Rs.25 CGST plus Rs.25 SGST) capped at 0.04 percent of turnover; for turnover between Rs.5 crore and Rs.20 crore it is Rs.100 per day with the same cap; and above Rs.20 crore it is Rs.200 per day capped at 0.5 percent of turnover. The fee accrues until the date of filing, so delays get expensive for larger businesses. Filing before 31 December avoids the entire cost.
Do I have to issue an invoice for every small cash sale in my shop?
Not necessarily. Where the value of a supply is less than Rs.200, the buyer is unregistered, and the buyer does not ask for an invoice, you may skip issuing an individual tax invoice. Instead, you must prepare one consolidated tax invoice at the close of each day covering all such small sales. The moment a customer demands an invoice, or the sale is Rs.200 or more, a proper invoice is required. Retail counters typically issue system receipts to every customer anyway, which is cleaner practice, but the daily consolidated invoice is the legal minimum for petty sales.
Does compensation cess still apply on any goods?
For most goods, no. With the rate restructuring of 22 September 2025, compensation cess was discontinued on items such as cars, and the demerit burden was merged into the single 40 percent rate. The cess continues only on pan masala and specified tobacco products during the transition period while past compensation cess loan obligations are being discharged. A practical point for traders: balances of unutilised compensation cess credit cannot be cross-utilised against CGST, SGST or IGST liability, so businesses holding old cess credit should evaluate their position rather than assuming it will set off future tax.
Is GST payable on my YouTube AdSense earnings?
AdSense payments come from a Google entity located outside India and are remitted in convertible foreign exchange, so for an Indian creator this revenue generally qualifies as export of services, zero-rated when supplied under an LUT after registration. The income still counts towards your Rs.20 lakh aggregate turnover, so a creator whose combined receipts cross the threshold must register even if the entire revenue is export. Brand sponsorships from Indian companies, by contrast, are domestic supplies taxable at 18 percent. Keep the remittance advices safely, as they establish the forex receipt if you later claim a refund of input tax credit.

Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
How do I file Form PMT-09 to move money between heads in my cash ledger?
Log in and open Services, then Ledgers, then Electronic Cash Ledger, and select File GST PMT-09 for transfer of amount. The screen shows your balance under each major and minor head. Choose the transfer-from head and amount, choose the transfer-to head, add the details to the table, preview and file with DSC or EVC. The transfer reflects in the ledger immediately and an ARN is generated for your records. There is no limit on how often PMT-09 can be filed, and no government fee applies, so it is always the first fix for a wrong-head deposit.
