CBIC explained the effect of the Supreme Court's order of 27 April 2021 extending limitation. The extension applies where an appeal has to be filed against a quasi-judicial order before the Joint or Additional Commissioner (Appeals), the Commissioner (Appeals), the Appellate Authority for Advance Ruling, the Tribunal or the courts, or where a revision or rectification of an order has to be sought. It does not apply to proceedings a taxpayer has to initiate or compliances he has to make, which remain governed only by the statute and by the notifications issued under section 168A of the CGST Act, nor to the quasi-judicial work of officers such as deciding refund claims, revocation applications and demand adjudications, which may continue.
What it means for you: A Chennai taxpayer who missed an appeal deadline during the pandemic waves can rely on this relief, but return filing dates were never covered by it.

An importer of toys challenged seizure and prohibition orders issued during a GST inspection. The Madras High Court partly allowed the petition, sustaining the seizure but modifying the prohibition order and directing provisional release of the goods on a personal bond plus a deposit of Rs. 2 lakh. The Court noted that the officers had not produced the material on which their reason to believe was founded, and took into account the severe business disruption caused by the pandemic.
Practical effect: Seized stock can often be released provisionally on bond and a modest deposit while the investigation continues, instead of remaining locked up indefinitely.
Tamil Nadu Labour Welfare Board - AAR Tamil Nadu, advance ruling reported August 2021 · 2021
The Board, based at the DMS Campus in Teynampet, Chennai, owned immovable property and let portions of it to government departments and business entities. It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.
Why this matters: Chennai landlords letting premises to government offices must charge GST unless a specific exemption entry clearly covers the letting.
