As COVID relief, the Council reduced late fee for all pending GSTR-3B returns for the tax periods from July 2017 to January 2020. Where there was no tax liability the late fee was reduced to nil, and where there was a tax liability it was capped at Rs 500 per return. The reduced or waived late fee applied only if the returns were furnished between 1 July 2020 and 30 September 2020. Certain clauses of the Finance Act, 2020 were brought into force.

What it means for you: This was the single largest late fee amnesty of the early GST years, and businesses that used it cleared years of backlog for a few hundred rupees per return.

Nil and nine per cent interest on delayed GSTR-3B for COVID months

Notification No. 31/2020-Central Tax · 2020-04-03

For the February, March and April 2020 tax periods CBIC lowered the interest rate on late GSTR-3B payment. Taxpayers with aggregate turnover above Rs 5 crore paid no interest for the first fifteen days after the due date and nine per cent thereafter, provided the return was filed by 24 June 2020. Taxpayers with turnover up to Rs 5 crore paid no interest at all if they filed within the extended dates specified for their turnover slab.

What to do about it: Interest demands for February to April 2020 must be recomputed under this concessional table, and many DRC-01 interest computations for that period are simply wrong.

Which input tax credits are blocked under Section 17(5) even if they appear in GSTR-2B?
Section 17(5) blocks credit on specified items regardless of business use: motor vehicles for passenger transport with seating up to thirteen persons, unless used for resale, passenger transport or driver training; food and beverages and outdoor catering; club and fitness memberships; life and health insurance except where statutorily obligatory; works contract and construction services for immovable property other than plant and machinery; goods lost, stolen, destroyed, written off or given as gifts and free samples; and tax paid under composition. Reversing these while filing GSTR-3B avoids painful demands later. A blocked-credit review is part of every reconciliation ChennaiGST performs.
Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act. Before this date the position was contested, with advance rulings going both ways, so credits availed for earlier periods may still be defensible on merits if questioned. It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC.
