The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

What it means for you: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.

GST Council

GSTR-3B introduced as a stopgap return for the first two months

17th GST Council Meeting, New Delhi — 18 June 2017 (PIB Release ID 1493128) · 2017-06-18

Responding to trade concerns about return readiness, the Council decided that for the first two months of GST, tax would be payable on a simple summary return, Form GSTR-3B, filed by the 20th of the following month. Invoice-wise details in GSTR-1 for July 2017 were to be filed between 1 and 5 September and for August between 16 and 20 September, with GSTR-2 auto-populated thereafter. This is the origin of the summary return that has governed monthly GST compliance ever since.

What to do about it: GSTR-3B was designed as a two-month stopgap and is still the return every Chennai business files monthly, which is why its legal status has been litigated repeatedly.

Interest on late returns was held payable on gross tax, later corrected by amendment

Megha Engineering and Infrastructures Ltd v. Commissioner of Central Tax — Telangana High Court, judgment dated 18 April 2019 · 2019-04-18

The taxpayer filed GSTR-3B late and paid interest only on the net cash portion of the tax. The High Court held that on the language of Section 50 as it then stood, interest ran on the gross liability, because input tax credit is credited to the ledger only when the return is filed. The decision caused wide concern in trade, and Parliament later amended Section 50 with retrospective effect from 1 July 2017 to charge interest only on the cash component in most late-return cases.

Practical effect: For late returns, interest is now generally computed on the cash portion only — if an older notice demands interest on gross tax, rely on the retrospective proviso to Section 50.

Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. I made a mistake in GSTR-3B. Can I revise it?
No, GSTR-3B cannot be revised once filed. The GST law allows corrections only through adjustments in the returns of subsequent tax periods. Since auto components also moved to 18% from September 2025, both lines of a typical job card now carry the same rate, which removes the old temptation to shift value between parts and labour. My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Track part deliveries against invoices in your inward register, and defer the credit in your reconciliation working until the final consignment is booked. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty.
