The High Court examined the power of arrest under Section 69 and held that it must be exercised with great care and only in exceptional circumstances, such as where a person is likely to tamper with evidence or abscond, is a habitual offender, or the evidence of a substantial offence is already clear. Arrest during investigation and before the liability has even been determined was deprecated, and the court listed situations in which arrest should ordinarily be avoided.
Why this matters: If a summons escalates towards arrest, this judgment is the standard authority for arguing that arrest must be an exception and not a pressure tactic.
Circular No. 49/23/2018-GST dated 21 June 2018 · 2018-06-21
This circular modified the detention procedure. The expression three working days in the earlier circular was replaced by three days, and the release wording in FORM GST MOV-05 was corrected. Most importantly it reiterated rule 138C(2): once physical verification of goods in transit has been carried out at one place, no further physical verification of the same conveyance may be done anywhere in India unless specific information relating to tax evasion is made available subsequently.
Practical effect: A truck already verified once should not be stopped and unloaded again on the same journey, and the earlier verification report is your defence.
Notification No. 1/2017-Central Tax (Rate), dated 28 June 2017 (G.S.R. 673(E)) · 2017-06-28
This was the founding rate notification for goods. It listed every taxable item against its Customs Tariff heading in six schedules, prescribing central tax of 2.5, 6, 9, 14, 1.5 and 0.125 per cent, which with the matching State tax gave the familiar 5, 12, 18, 28, 3 and 0.25 per cent rates. Anything not listed in a schedule or exempted separately fell to the residual 18 per cent rate. It was amended dozens of times before being superseded on 22 September 2025.
What it means for you: For any dispute about a supply made up to 21 September 2025, the rate must be traced to the schedule entry of this notification as it stood on the date of supply, not to today's rate.
