The Council reduced GST on all electric vehicles from 12 per cent to 5 per cent and on chargers or charging stations for electric vehicles from 18 per cent to 5 per cent. Hiring of electric buses with carrying capacity of more than twelve passengers by local authorities was exempted. All these changes took effect from 1 August 2019. The Council also extended the last date for opting into the six per cent service composition scheme in CMP-02 to 30 September 2019.
Practical effect: Electric vehicle dealers and charging point operators in Chennai bill at five per cent, a rate that has survived every later rate revision including GST 2.0.

This circular settled several long-running food service disputes. It clarified that service by cloud kitchens and central kitchens is restaurant service attracting 5 per cent without input tax credit, while ice cream parlours that sell already manufactured ice cream without any element of cooking supply goods and attract the applicable goods rate with credit. It also clarified the treatment of coaching services supplied under a government scholarship scheme, overloading charges recovered at toll plazas, and services in relation to admission to amusement parks.
What it means for you: A Chennai cloud kitchen bills at 5 per cent without credit, but an ice cream parlour selling tubs and cones must charge the goods rate and can keep its credits.

The applicant promoted courses of foreign universities in India and recruited students for them, receiving commission in foreign exchange. It claimed the service was an export and therefore zero rated. The West Bengal Authority for Advance Ruling, affirmed on appeal, held that the applicant merely facilitates admission of students to the university and is an intermediary under Section 2(13) of the IGST Act. As the place of supply of an intermediary is the location of the supplier, the service is a domestic supply liable to GST.
What it means for you: Businesses earning foreign commission for facilitating a third party's supply should test the intermediary risk before treating receipts as zero-rated exports.
