India Yamaha Motor (P) Ltd v. Assistant Commissioner — Madras High Court, W.P. No. 19044 of 2019, decided 29 August 2022 (Anita Sumanth J.) · 2022-08-29

The taxpayer argued that because credit was sitting in its electronic credit ledger, no interest should arise on delayed returns. The Madras High Court largely rejected this, confirming an interest demand of about Rs. 1.19 crore and holding that credit is set off against output tax only when it is actually debited at the time the return is filed. Availability of a credit balance, without an accompanying return, does not amount to discharge of tax.

The statement of self-assessed tax in Form GST CMP-08 for the quarter ending 31 March 2020 was allowed to be furnished up to 7 July 2020 instead of 18 April 2020. The annual return in Form GSTR-4 for the financial year 2019-20 was allowed up to 15 July 2020 instead of 30 April 2020. This was the first COVID concession specifically for composition taxpayers, who had otherwise been left out of the relief given to regular filers.

Is there a deadline for declaring credit notes for a financial year?
Yes, and it is strict. A credit note relating to an invoice of a financial year must be declared in your returns by 30 November following the end of that financial year, or the date of filing the annual return, whichever is earlier. After this date, you can no longer reduce your output tax through a GST credit note for that year's invoices; any adjustment becomes purely commercial with no tax benefit. Which goods and services attract the new 40 percent GST rate?
The 40 percent rate is confined to luxury and demerit supplies.
