The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.
What to do about it: Chennai lodges charging under one thousand rupees a night and hospitals with deluxe rooms above five thousand rupees a day both acquired new GST liabilities from 18 July 2022.

The Supreme Court dismissed the department's appeal and confirmed that where a holding company issues a corporate guarantee for its group companies without charging any consideration, no service tax is leviable. A taxable service requires consideration, and where none flows, the charge fails. Under GST the position has since been altered by a specific valuation rule for corporate guarantees between related persons, so the current position must be checked separately.

Where a taxpayer repays an erroneously sanctioned refund of accumulated input tax credit, together with interest and penalty, through FORM GST DRC-03, the amount can be restored to the electronic credit ledger. The circular prescribes the procedure: the taxpayer makes an application to the jurisdictional officer, and the officer re-credits the amount by an order in FORM GST PMT-03A. This ensures the taxpayer does not effectively bear the same credit twice.
What it means for you: If a Chennai exporter has repaid a wrongly sanctioned refund through DRC-03, apply in writing for a PMT-03A re-credit rather than treating the credit as lost.
