Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04
The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.
What to do about it: Chennai hostel and paying guest operators should not assume exemption; the outcome turns on the exact facts and on later High Court rulings.

Following the 45th GST Council meeting, CBIC settled several long-running classification quarrels. Exemption for fresh fruit and nuts covers only produce that has not been dried; once dried, they move to the taxable schedule. Tamarind seeds, copra as distinct from edible coconut, pure mehendi paste without additives, scented and flavoured sweet supari, brewers' spent grain and distillers' grains were each assigned a rate, and the position on renewable energy project valuation was restated.

The annual return in Form GSTR-4 for the financial year 2020-21, originally due on 30 April 2021, was first extended to 31 May 2021 by the notification of 1 May 2021 and then further extended to 31 July 2021 by the notification of 1 June 2021. Composition taxpayers had been badly affected by the second wave and by the fact that GSTR-4 had only recently changed from a quarterly to an annual return, causing widespread confusion about the filing period.
What it means for you: Chennai composition dealers had until 31 July 2021 for the 2020-21 annual return, which is the date from which any late fee for that year is correctly computed.
