Where an appellate authority, tribunal or court holds that a notice issued under Section 74 is not sustainable because fraud, wilful misstatement or suppression of facts is not established, Section 75(2) requires the proper officer to re-determine the tax as though the notice had been issued under Section 73. The Board clarified that this re-determination must be completed within two years from the date of communication of that order, and only the normal period demand can survive.

What to do about it: Winning on the suppression point in appeal does not end the matter, but it limits the surviving Chennai demand to the normal period and starts a two-year clock on the department.

How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Under Notification 78/2020 Central Tax, taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year must mention a 4-digit HSN code on all B2B tax invoices, though it is optional on B2C invoices. Taxpayers with turnover above Rs.5 crore must mention 6-digit HSN codes on every invoice, including B2C.
