Trade Profile and GST Jurisdiction for Agaram

Agaram is a tight grid of workshops and homes between Peravallur and Sembium, with tailoring and hosiery units, footwear stitchers, cycle and two wheeler mechanics and small foundries along Loco Works Road and Kumaran Nagar Main Road. Market Street, Temple Road and the Paper Mills Road frontage carry grocery and rice wholesalers serving the Perambur belt, while Jaganathan Colony and Bharathi Nagar hold rented workshop sheds. Composition scheme limits, unregistered job work movements and cash sale invoicing gaps drive most notices received here. Years of working in and around Agaram have shown us where GST trouble actually begins here — supplier defaults, classification doubts and deadlines lost in busy trading weeks. Our DRC-01/DRC-01A Demand Reply is built to close precisely those gaps, and the same team supports businesses in Peravallur and Sembium, each with one point of contact and a compliance calendar maintained on their behalf.

GST jurisdiction for Agaram (PIN 600082): businesses here generally fall under the CGST Chennai North Commissionerate. We regularly represent clients from Agaram before this jurisdiction for registrations, clarifications and notice hearings, and can confirm your exact division and range from your GSTIN. State-jurisdiction cases are handled with the Tamil Nadu Commercial Taxes Department.
GST for Agri Traders and Food Processors in Agaram
Agricultural trade straddles the exempt-taxable border. Fresh and unprocessed produce is exempt, but the same goods become taxable at 5 percent once sold pre-packaged and labelled under the Legal Metrology Act, so packing decisions change tax outcomes. Buying raw cotton or cashew nuts directly from agriculturists shifts the tax onto the buyer under reverse charge under Section 9(3). Traders in Agaram mixing exempt and taxable turnover must reverse proportionate credit under Rule 42 on godown rent, transport and other common expenses. A specialist classifies each product line correctly, computes reverse charge on farm-gate purchases, and documents the packaging distinction officers examine first.
Yes, DRC-01/DRC-01A Demand Reply in Agaram can be completed fully online — no office visit is required at any stage, since e-signatures, OTP verification and digital document exchange cover the entire formality, with fees from Rs.4,999.
Why Us

Why Agaram Businesses Choose ChennaiGST

Not a bulk-filing portal. A senior consultant knows your file, your jurisdiction and your deadlines.

✓

Advisory, Not Just Data Entry

We tell you when the composition scheme stops making sense, when QRMP suits your cash flow, and when a supplier's non-compliance is quietly costing you credit. Filing is the minimum; helping you make better GST decisions is the actual job.

✓

Job Work Movements Tracked Through ITC-04

Goods sent to job workers must move on delivery challans, return within the statutory period, and be reported in ITC-04. We track every outward and return leg for manufacturing clients in Agaram, so inputs sent out for processing never quietly convert into a deemed supply carrying tax and interest.

✓

Every Return Reviewed by a Senior Consultant

No filing leaves our desk on a junior's judgement alone. A senior GST practitioner reviews your figures, ITC claims and tax computation before submission, so errors are caught at our table and not by the department months later through a notice.

✓

Familiar with Chennai Jurisdictions and Officers' Expectations

We work with Chennai GST ranges and circles every week, including the jurisdiction covering Agaram. We know how local proper officers examine registrations, what supporting documents they routinely call for, and how to present a file so it moves without repeated queries.

✓

Extra Hands During Filing Windows

In the days before the 11th and the 20th, our team runs extended hours and a strict internal queue, so a client who sends data late in the window is still filed on time. Peak-season crush at our end never becomes a late fee at yours.

✓

Clean Exits When a Business Closes

Winding up attracts its own GST obligations — the cancellation application, reversal of credit on closing stock, and the final return in GSTR-10 within three months. We close registrations properly so a business you shut in Agaram never writes back to you as a demand years later.

How It Works

Our Demand Reply Process

Demand analysis

We examine whether the notice is under Section 73 or 74, check the limitation period, and break the demand into issues that can be defended separately.

Merits assessment

Each issue is tested against your records, GSTR-2B and case law, and we give you a candid view of what is defensible and what is genuinely payable.

DRC-06 reply drafting

A detailed statutory reply is drafted in Form DRC-06 with reconciliations, invoices and legal grounds, shared for your approval and filed on the portal in time.

Hearing and payment strategy

We represent you at the personal hearing. For any admitted liability we file DRC-03 promptly, using the concessional closure available under Section 73 where applicable.

Order and next steps

We track the adjudication outcome, review any order in DRC-07, and advise on rectification or appeal in APL-01 within three months if the demand is confirmed.

Outcomes

What You Get

Practical outcomes our clients measure us by.

★

A Clean GSTIN That Stays Active

Continuous filing protects you from the suspension and cancellation proceedings that hit chronic non-filers, so your registration, e-way bill access and ability to issue tax invoices are never suddenly cut off.

★

Time Back for Your Actual Business

The hours you or your accountant spent wrestling with the portal, JSON errors and reconciliations every month return to sales, operations and customers, while trained hands manage the compliance in the background.

★

Waiver Benefits Never Missed

Late-fee waivers and amnesty windows notified by the GST Council are applied to your history within their deadlines, capturing reliefs that most businesses only hear about once the window has already closed.

★

Books and Returns That Agree at Year End

Because turnover in your GST returns is kept aligned with your accounts through the year, income tax filing and statutory audit proceed without the GST-versus-books mismatch queries that now surface routinely through data matching.

★

Compliance That Continues When You Travel

Illness, travel or a family function no longer threatens a deadline. With a standing external process holding your calendar and data trail, filings proceed on schedule whether or not you are at your desk.

★

No More Late Fees

With returns filed ahead of the statutory due dates every period, the Rs.50-per-day GSTR-3B late fee simply stops appearing in your life, and the money stays in your business where it belongs.

Why a Specialist Matters

With ChennaiGST vs Doing It Yourself

AspectWith ChennaiGSTDIY / Unattended
Record keepingEvery return, challan, acknowledgement and working paper archived in an organised folder, retrievable in minutes years later.Documents scattered across email, downloads and old phones; assembling records for a bank or an audit takes days.
Annual return preparationMonthly reconciliations roll naturally into GSTR-9, filed comfortably before 31 December with figures already agreed through the year.Twelve months of unmatched data reconstructed in December, with differences discovered too late to be corrected cleanly.
Risk of noticesGSTR-1, GSTR-3B and GSTR-2B reconciled before filing, removing the mismatches that trigger most scrutiny notices.Inconsistent figures across returns quietly build a mismatch history that surfaces later as ASMT-10 scrutiny or a demand notice.
Goods in transitE-way bills generated correctly and matched to invoices, so consignments pass roadside inspections without detention or penalty.A defective or missing e-way bill can mean detention at a checkpoint, with penalties that dwarf the tax on the consignment.
Input tax creditPurchase register matched against GSTR-2B each period, with defaulting suppliers chased so eligible credit is actually captured.Credit claimed from books alone; mismatches with GSTR-2B mean lost credit or excess claims that invite departmental queries.
Registration and amendmentsQuery-resistant applications prepared correctly the first time, with supporting documents matched to what proper officers actually verify.Repeated clarification memos and resubmissions, with weeks lost because a rent agreement or premises photograph did not meet expectations.
Law Update

GST Rulings and Notifications That Affect You — relevant to Agaram businesses

GST law moves through notifications, circulars and court decisions. These are the ones changing how filings are prepared right now.

Case Law

Supreme Court lays down the aspect doctrine for splitting composite transactions

Bharat Sanchar Nigam Ltd v. Union of India — Supreme Court, (2006) 3 SCC 1, judgment dated 02-03-2006 · 2006-03-02

The Supreme Court held that the same transaction may have a goods aspect and a service aspect, and different legislatures may tax different aspects, but the same element cannot be taxed twice. A composite contract cannot be split into goods and services except in the cases specifically permitted by Article 366(29A), such as works contracts and catering. The dominant nature test was applied to decide the character of the contract.

Why this matters: Chennai businesses with bundled offerings should determine the dominant character of the supply, since that decides classification and rate under GST.

AAR Ruling

Club membership and admission fees held not to be consideration for any supply

Rotary Club of Mumbai Queens Necklace — AAAR Maharashtra (2019), on appeal from AAR Maharashtra, Advance Ruling No. GST-ARA-118/2018-19 · 2019

The club collected membership subscriptions and admission fees which were spent on meetings, administration and communication, with no facility or benefit supplied to members in return. The Maharashtra Appellate Authority for Advance Ruling held that the collections merely defray shared expenses, that there is no supply of goods or services to members, and that the amounts are therefore not consideration liable to tax.

Practical effect: Chennai associations should note that Section 7(1)(aa), inserted with retrospective effect from 1 July 2017, now treats club to member supplies as taxable, so this reasoning no longer holds.

Notification

Nil and nine per cent interest on delayed GSTR-3B for COVID months

Notification No. 31/2020-Central Tax · 2020-04-03

For the February, March and April 2020 tax periods CBIC lowered the interest rate on late GSTR-3B payment. Taxpayers with aggregate turnover above Rs 5 crore paid no interest for the first fifteen days after the due date and nine per cent thereafter, provided the return was filed by 24 June 2020. Taxpayers with turnover up to Rs 5 crore paid no interest at all if they filed within the extended dates specified for their turnover slab.

What it means for you: Interest demands for February to April 2020 must be recomputed under this concessional table, and many DRC-01 interest computations for that period are simply wrong.

Already Holding the Notice? Read It in About a Minute

Upload the PDF to our free GST Notice Analyser. No payment, no account. If the notice does not state a date we can read, it says so rather than guessing one for you.

FAQs

Frequently Asked Questions

Straight answers from practising GST consultants — based on the CGST Act, current CBIC notifications and day-to-day portal experience.

What is the process for DRC-01/DRC-01A demand reply?
The process runs in clear stages: Demand analysis; Merits assessment; DRC-06 reply drafting; Hearing and payment strategy. A senior consultant reviews your file at each stage rather than passing it to a data-entry desk, and you receive a confirmation with the filed documents once it is complete. You always know which stage your work is at — we update you on WhatsApp instead of leaving you to follow up.
Can I get DRC-01/DRC-01A demand reply done online without visiting the office?
Yes, the entire process can be handled online. You share scanned documents on WhatsApp or email, we prepare and file everything on the GST portal, and you receive the acknowledgement and filed copies digitally. Businesses in Agaram regularly complete demand reply with us without a single office visit. If a physical verification or personal hearing is required by the department, we guide you through it.
How much time does the GST department have to issue a demand under Section 73?
For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. Always check limitation first; notices issued beyond these dates can be challenged as time-barred, which ChennaiGST examines in every Agaram demand case.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. Select the correct cause of payment and period in the form, because a wrongly mapped DRC-03 creates reconciliation trouble later.
What are the exact steps to file a DRC-03 voluntary payment on the GST portal?
Log in and go to Services, then User Services, then My Applications, choose Intimation of Voluntary Payment DRC-03 and click New Application. Select the cause of payment, such as voluntary, show cause notice, audit or annual return, pick the section and financial year, and enter the tax, interest and penalty amounts head-wise under IGST, CGST and SGST. A saved draft remains available for fifteen days. Offset the amounts from your ledgers, sign with DSC or EVC, and download the ARN acknowledgement. Our Agaram office files DRC-03 the same day for clients; call +91 - 9600 606 444.
I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Agaram cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. Where a supplier has genuinely defaulted, quantify and pay only that portion through DRC-03 rather than conceding the entire demand.
How do I reply to a DRC-01 show cause notice online?
The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. Log in, open View Additional Notices and Orders, select the case and use the reply option to upload your written submissions and supporting documents, and opt for a personal hearing. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. File within the time allowed in the notice. ChennaiGST drafts DRC-06 replies for Agaram businesses with a hearing strategy built in from the start.
What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. Many Agaram taxpayers discover notices only after the order stage because they never checked the Additional Notices tab, so a quick portal review is the first step.
I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. A rate review after the September 2025 changes is worth doing for every Agaram business; call +91 - 9600 606 444 for one.
Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. Retail schemes such as festival discounts and trade margins should always be structured to print on the invoice.
What does a GST consultant in Agaram typically charge for refund and compliance work?
Fees vary with complexity. Simple filings such as an LUT or an excess cash ledger refund are usually fixed-fee assignments, while export and inverted duty refunds involve invoice statements, formula workings and departmental follow-up, so they may be priced as a fixed fee or a small percentage of the refund secured. Monthly reconciliation and return packages are subscription-based. ChennaiGST publishes transparent pricing starting at Rs.4,999 with no percentage cut on straightforward claims, and you pay only after the scope is agreed in writing. Call +91 - 9600 606 444 for a quote specific to your turnover and refund type.
I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?
Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
How do I register my DSC on the GST portal, and why does the emSigner error keep appearing?
After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. Run emSigner as administrator, keep the token connected, and use the trusted-site settings the portal recommends. We troubleshoot DSC issues for Agaram companies routinely; call +91 - 9600 606 444.
Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Multi-state businesses headquartered in Agaram use this to shift idle deposits to the branch that actually needs the cash, avoiding fresh working capital outflow.
What are the common types of GST notices a business can receive?
The frequent ones are: REG-03 seeking clarification on a registration application; GSTR-3A for non-filing of returns; ASMT-10 pointing out discrepancies found on scrutiny of returns; DRC-01A intimating an ascertained tax liability before formal proceedings; DRC-01, the show cause notice under Section 73 or 74; ADT-01 intimating a departmental audit; REG-17 proposing cancellation of registration; RFD-08 proposing rejection of a refund claim; and summons under Section 70. Each has its own reply form and deadline, ranging from seven working days to thirty days, so identifying the notice type correctly is the first step in responding. When in doubt, call +91 - 9600 606 444.
How do I decide whether to charge CGST plus SGST or IGST on an invoice?
Compare two data points: the location of the supplier and the place of supply determined under the IGST Act. If both fall in the same state, the supply is intra-state and you charge CGST plus SGST; if they fall in different states, it is inter-state and you charge IGST. The buyer's billing address alone is not the test; the place of supply rules for the specific goods or service govern. Common traps include hotel stays, property-linked services and bill-to ship-to chains, where the place of supply departs from the customer's address. Configuring these rules in your billing software saves Agaram businesses repeated corrections; call +91 - 9600 606 444 for a setup review.
Do you provide drc 01 notice reply for small businesses and proprietorships in Agaram?
Yes. A large share of our clients in Agaram are proprietors, small traders, shop owners, freelancers and family businesses rather than large companies. The fee of Rs.4,999 and the process are the same regardless of size, and we explain the compliance position in plain language — in Tamil or English — so you understand what is being filed on your behalf and why.
What documents are required for DRC-01/DRC-01A demand reply in Agaram?
For DRC-01/DRC-01A demand reply you will generally need: Copy of DRC-01 or DRC-01A with annexures, GST portal login credentials, GSTR-1, GSTR-3B and GSTR-9 copies for the disputed periods, GSTR-2A and GSTR-2B data for the disputed periods, Purchase invoices and supplier ledger for ITC disputes. The exact list depends on your constitution — proprietorship, partnership, LLP or company — and on the specifics of your case. Send what you have on WhatsApp to +91 - 9600 606 444 and we will confirm within the same working day exactly what else is needed, so nothing is rejected later for a missing paper.
Are there any hidden charges for DRC-01/DRC-01A demand reply?
No. The fee quoted before we start is the fee you pay. Government fees, portal charges or statutory late fees, where they apply, are separate and disclosed to you in advance with the exact amount. We issue a proper GST invoice for our professional fee. If the scope of work changes — for example, an unexpected notice or additional periods — we tell you the revised fee before doing anything further.
