GSTN Advisory, January 2024 — introduction of Tables 14 and 15 in GSTR-1 and the Invoice Furnishing Facility · 2024-01
From the January 2024 tax period, GSTR-1 and the Invoice Furnishing Facility carry two additional tables. Table 14 is filed by the seller and splits supplies made through an e-commerce operator between those on which the operator collects tax at source under Section 52 and those on which the operator itself pays tax under Section 9(5). Table 15 is filed by the e-commerce operator for supplies on which it discharges the tax under Section 9(5).
How we apply it: Sellers on marketplaces must map each order to the correct table, because mismatches here drive notices on tax collected at source credit.

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.
What to do about it: Chennai lodges charging under one thousand rupees a night and hospitals with deluxe rooms above five thousand rupees a day both acquired new GST liabilities from 18 July 2022.

CBIC clarified four refund issues. The two-year time limit in section 54(1) does not apply to a refund of excess balance in the electronic cash ledger, and no certificate or declaration under rule 89(2)(l) or (m) is required for such a claim. Amounts deducted or collected as TDS or TCS under sections 51 and 52 and credited to the cash ledger are equivalent to cash and, once tax dues are met, the unutilised balance can be refunded as excess cash balance.
What to do about it: Money lying idle in the cash ledger, including unused TDS and TCS credits, can be claimed back at any time, which is useful for e-commerce sellers and government contractors.
