Goods were detained because the squad officer disagreed with the HSN classification and rate adopted by the consignor. The Madras High Court quashed the detention, holding that a squad officer may intercept goods and prepare the record but cannot finally decide questions of classification or rate, which belong to the jurisdictional assessing officer. The Court directed the Commissioner of Commercial Taxes to instruct squad officers not to detain goods where there is a bona fide dispute about exigibility or rate of tax.
What it means for you: If your consignment is detained purely because an officer prefers a different HSN code or rate, that dispute belongs before your assessing officer, not at the roadside.
