A penalty order demanding tax with 200 per cent penalty was passed because the company operated an additional place of business that had not been added to its registration. The Madras High Court quashed the penalty, finding it harsh on the facts: the invoice and e-way bill had been generated before the seizure, and the failure to register the extra premises was a technical and venial breach rather than a deliberate attempt at evasion.
What it means for you: A missing additional-place-of-business entry is a compliance slip, not evasion — a maximum penalty on that footing can be challenged in Tamil Nadu.

From 1 January 2025, the e-way bill system does not permit generation of an e-way bill against a base document, such as an invoice, that is more than 180 days old on the date of generation. In addition, the total validity of an e-way bill, including all extensions, is capped at 360 days from its original generation date. The change curbs misuse of stale invoices for movement of goods.
What it means for you: Plan dispatches so invoices are used for movement well within 180 days, and monitor long-haul consignments against the 360-day extension cap.

CBIC laid down a uniform procedure for interception of vehicles carrying goods. The officer issues a statement in FORM GST MOV-01, an order of inspection in MOV-02, records the inspection report in Part A of FORM GST EWB-03 within twenty-four hours and the final report in Part B within three days, and then releases the goods in MOV-05 or issues a detention order in MOV-06 with a notice in MOV-07. Confiscation follows in MOV-10 and MOV-11.
What it means for you: If a consignment is detained on a Chennai highway or at a check post, insist on the MOV forms and the prescribed time limits, because departures from this sequence are a strong ground of challenge.
