Volvo-Eicher Commercial Vehicles Ltd — AAAR Karnataka, order dated 6 February 2020 (appeal from AAR Karnataka, Advance Ruling No. KAR ADRG 32/2019, dated 12 September 2019) · 2020-02-06
The company repaired Volvo vehicles in India during the warranty period and recovered the cost from Volvo Sweden, which owned the warranty obligation. The Karnataka Appellate Authority for Advance Ruling held that the service is rendered to the foreign manufacturer and not to the Indian vehicle owner. Since the recipient is outside India and payment is received in convertible foreign exchange, the transaction qualifies as export of service and is zero-rated.

At the first meeting chaired by Finance Minister Nirmala Sitharaman, the Council decided to introduce an electronic invoicing system in a phase-wise manner for business-to-business transactions. The press release recorded that e-invoicing would help taxpayers with backward integration and automation of tax-relevant processes and would help authorities combat evasion, with Phase 1 proposed to be voluntary and rolled out from January 2020. The Supreme Court held that levying IGST on ocean freight under reverse charge from the Indian importer, when the importer already pays IGST on the CIF value of imported goods, amounts to double taxation and is unconstitutional. The Court also made the landmark observation that GST Council recommendations are not binding on the Union or the States, and Parliament and State legislatures have simultaneous power to legislate on GST.
