Notification No. 09/2017-Central Tax dated 28.06.2017 · 2017-06-28
This notification appointed 1 July 2017 as the date on which the remaining provisions of the Central Goods and Services Tax Act, 2017 came into force, that is, all the sections not already notified by Notification 01/2017-Central Tax. From this date the levy under section 9, the input tax credit provisions, the return, payment, refund, assessment, audit, demand and appeal machinery all became operative.
What to do about it: For a Chennai business, 1 July 2017 is the dividing line, transactions before it are governed by VAT, service tax and excise, and transactions from that date by GST.

Implementing the 53rd GST Council recommendation, CBIC fixed monetary thresholds below which the department will not file appeals: Rs 20 lakh for the GST Appellate Tribunal, Rs 1 crore for High Courts and Rs 2 crore for the Supreme Court, subject to exclusions for questions of law and recurring issues. This reduces litigation dragged on by routine departmental appeals and gives finality to smaller favourable orders won by taxpayers.
How we apply it: If you win a GST dispute below these thresholds, the department generally cannot appeal further, so favourable first-appeal orders in small cases are effectively final.

The Supreme Court held that a show cause notice must clearly specify the action or penalty proposed, so that the noticee can meet the case against him. An authority cannot impose a consequence that was never put to the party in the notice. Any order that goes beyond the scope of the notice is bad in law and liable to be set aside for breach of natural justice.
What to do about it: If a Chennai business receives an order confirming a demand or penalty on grounds never raised in the notice, that order can be challenged as beyond jurisdiction.
