Notification No. 10/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

Superseding the 2017 exemption notification, this list re-notifies all nil-rated goods with effect from 22 September 2025 and widens it significantly. Ultra-high temperature milk became exempt, chena and paneer became exempt whether or not pre-packaged and labelled, and all Indian breads including roti, chapathi, paratha, parotta, khakhra and pizza bread were exempted by name. Pencils, crayons, sharpeners, slates, maps, globes and exercise books were also brought to nil.

What to do about it: Dairy shops and bakeries in Chennai now bill paneer and parotta at nil, but must remember that exempt turnover blocks the corresponding input tax credit.

If I lose the first appeal, what does it cost to go to the GST Appellate Tribunal?

To file an appeal you must pay the admitted tax, interest and penalty in full, plus a pre-deposit of 10 percent of the disputed tax amount. Only the tax in dispute counts for the 10 percent; disputed interest and penalty do not require any pre-deposit, except that an appeal against an e-way bill detention penalty order under Section 129(3) requires payment of 25 percent of the penalty. Once the appeal is filed with this payment, recovery proceedings for the balance amount are deemed stayed until the appeal is decided. The pre-deposit can be paid from the electronic cash ledger, and courts have also accepted credit ledger payment for the tax component. What happens after I file Form APL-01 on the GST portal?

Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. The GST rate on my product changed. Which rate applies to pending orders and invoices?
Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies. I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?
Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
I deposited money under the wrong head in my GST cash ledger. Why can the amount not be used?
The cash ledger is divided into major heads, IGST, CGST, SGST and cess, and minor heads, tax, interest, penalty, fee and others.
