Rich Dairy Products (India) Pvt Ltd - AAR Tamil Nadu (2019), upheld by AAAR Tamil Nadu, Order No. TN/AAAR/01/2020 · 2019

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

What to do about it: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

Notification No. 9/2025-Central Tax (Rate), dated 17 September 2025, Schedule I, Chapters 4 to 21 · 2025-09-17

Schedule I places butter, ghee and other dairy fats, cheese, condensed and concentrated milk, yoghurt, pre-packaged and labelled curd, lassi and buttermilk, natural honey, roasted coffee, pasta and seviyan, namkeens, bhujia and mixture, ice cream and other edible ice, biscuits, sauces and most processed foods at five per cent. Chena and paneer, ultra-high temperature milk and Indian breads are fully exempt under the companion exemption notification, so the food chain now runs at either nil or five per cent.

Why this matters: Supermarkets and food distributors in Chennai should be charging five per cent or nil on almost their entire grocery range from 22 September 2025.

Expired e-way bill not extended in time — penalty upheld and writ petition dismissed

M/s. Ajay Agency v. State Tax Officer — Madras High Court, W.P. No. 8507 of 2023, decided 30 March 2023 (Anita Sumanth J.) · 2023-03-30

A consignment of power weeders was intercepted on 6 March 2023 at about 10.30 a.m., the e-way bill having expired at 11.59 p.m. the previous night. The taxpayer pleaded a vehicle breakdown. The Court declined to interfere, noting that the validity could have been extended within the permitted window and had not been, and that the officer's decision to detain and penalise under Section 129(1) was not unreasonable. The writ petition was dismissed with liberty to file a statutory appeal.

Practical effect: Chennai transporters must extend e-way bill validity within the permitted window when a vehicle breaks down; the High Court will not excuse an expired bill merely because of a breakdown.

My three-month appeal deadline has passed. Can I still file a GST appeal?
You have a narrow lifeline. The appellate authority can condone a delay of up to one month beyond the three-month limit if you demonstrate sufficient cause, such as illness or circumstances genuinely beyond control, so file APL-01 immediately with a detailed condonation application and evidence. Beyond three months plus one month, the appellate authority has no statutory power to admit the appeal, and your remaining options shrink to a writ petition before the Madras High Court in fit cases, or any amnesty scheme the government may notify. How much pre-deposit do I have to pay for a GST appeal?
To file an appeal you must pay the admitted tax, interest and penalty in full, plus a pre-deposit of 10 percent of the disputed tax amount. Only the tax in dispute counts for the 10 percent; disputed interest and penalty do not require any pre-deposit, except that an appeal against an e-way bill detention penalty order under Section 129(3) requires payment of 25 percent of the penalty. Once the appeal is filed with this payment, recovery proceedings for the balance amount are deemed stayed until the appeal is decided. The pre-deposit can be paid from the electronic cash ledger, and courts have also accepted credit ledger payment for the tax component. What happens after I file Form APL-01 on the GST portal?
The portal issues a provisional acknowledgment immediately, and the appeal is formally admitted when the final acknowledgment in APL-02 is issued after document verification. Up to three adjournments may be granted per side. Once the sixty-day window and the further sixty-day extended window under Section 62 have both lapsed, filing the return no longer withdraws the order, and the estimated demand in the liability register becomes recoverable. Your remedy shifts to an appeal in Form APL-01 within three months of the order's communication, with the prescribed pre-deposit, arguing the actual figures from your books against the officer's estimate. Appellate authorities regularly scale down best judgment estimates when the genuine return data is placed on record. Which GST orders can I appeal against?
Any decision or order passed by an adjudicating authority under the GST Acts can be appealed in Form APL-01. Common examples are demand orders under Section 73 or 74 summarised in DRC-07, registration cancellation orders in REG-19, refund rejection orders in RFD-06, best judgment assessment orders in ASMT-13, and penalty orders, including detention cases involving e-way bill lapses. A few matters are excluded, such as orders on transfer of proceedings and seizure directions. This is the most common revocation scenario we see in Padi. How do I reply to a DRC-01 show cause notice online?
The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. Log in, open View Additional Notices and Orders, select the case and use the reply option to upload your written submissions and supporting documents, and opt for a personal hearing. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
Why is my e-way bill generation blocked on the portal?
Under Rule 138E, the e-way bill facility is blocked when a taxpayer has not filed GSTR-3B (or CMP-08 for composition dealers) for two or more consecutive tax periods. Since an e-way bill is mandatory for moving goods worth more than Rs.50,000, blocking effectively halts dispatches. The remedy is straightforward: file the pending returns with late fee and interest, after which the facility unblocks automatically, usually the next day. What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital. Repeated delays lead buyers to withhold the GST portion of payments or move to more compliant vendors. Timely GSTR-1 filing is therefore a commercial necessity, not just a legal one. What falls under the 18 percent standard rate of GST now?

From 22 September 2025, following the 56th GST Council meeting, India moved to a simplified two-slab structure: a merit rate of 5 percent and a standard rate of 18 percent. The earlier 12 percent and 28 percent slabs were abolished. A special 40 percent rate applies to a short list of luxury and demerit goods, while the concessional rates of 3 percent on gold and silver and 0.25 percent on rough diamonds continue.
